Do you publish poems online and want to print a volume? Here's what the law says
Many authors who publish their creations on online platforms end up wondering, at some point, whether their digital presence can affect their chances of getting a book printed. The answer, supported by current legislation and editorial practice, is reassuring.
Copyright does not depend on where you publish
Copyright legislation protects the author automatically, from the moment the work is created — not from publication, not from registration, and not from printing.
In Romania, this principle is regulated by Law no. 8/1996 on copyright and related rights. In the Republic of Moldova, the equivalent legal framework is Law no. 139/2010 on copyright and related rights. Although they are distinct normative acts, both enshrine the same fundamental principle: copyright belongs to the creator of the work by the simple fact of creation, regardless of the medium on which it is made public — printed, digital, or audio.
Publishing on an online platform does not transfer copyright to that platform and does not diminish the author’s rights in any way. Moral rights — which include the right to be recognized as the author, the right to decide whether and when the work becomes public, and the right to the integrity of the work — are inalienable and cannot be assigned by any contract, in both jurisdictions.
Publishing online is, in fact, proof of authorship
One aspect that many authors do not take into account: the date of online publication constitutes clear proof of authorship of the work. In the event of a plagiarism dispute, an author who has published his poems on a digital platform with a registered date can easily demonstrate the antecedence of the creation to any other appearance of the same text. The platform’s servers record the exact date and time of publication, and this information can be used as evidence.
In other words, publishing online does not expose the author to additional risk — on the contrary, it protects him.
What Publishing Contracts Provide
Contracts with publishers may include exclusivity clauses for the commercial exploitation of a printed volume. It is important for any author to read carefully before signing and identify the terms that refer to exclusive rights, first publication or withdrawal from circulation.
In practice, these clauses usually refer to the full publication of the volume as such — not the presence of individual texts on the Internet. Serious publishers understand that an author with online visibility already has a built-in audience, which is a commercial advantage, not an impediment. If a clause raises questions, any contractual element is negotiable.
Writers' Union and admission criteria
The Writers' Union of Romania and the Writers' Union of Moldova do not condition the admission of an author or the recognition of his literary activity on the absence of an online presence. The official criteria for admission to the USR refer exclusively to the existence of a printed volume from a recognized publishing house. There is no provision that restricts or sanctions simultaneous publication on digital platforms.
Examples from international literary practice
Numerous internationally renowned authors have built their careers starting from the online environment. Canadian poet Rupi Kaur published for years on Instagram before her book Milk and Honey became a world bestseller, with over four million copies sold. Margaret Atwood, Neil Gaiman and many other authors with dozens of printed titles have active digital presences, without this ever representing an editorial obstacle.
In the Romanian space, an author's online presence is increasingly seen as an indicator of seriousness and commitment to their own literary career.
Online publishing and printing a volume are compatible — legally, contractually and practically. The author who publishes on a digital platform retains full copyright, benefits from additional proof of authorship and builds a real audience before the printed volume appears. The decision to withdraw creations from the online environment can be made at any time, but there is no legal obligation to do so and, in the absence of an explicit contractual clause, no editorial justification for doing so.
